Agreement to Terms

By booking swim lessons with Nuvo Swim LLC ("Nuvo Swim," "we," "us," or "our"), you agree to be bound by these Terms of Service. Please read them carefully before scheduling any lessons.

Services Provided

Nuvo Swim provides mobile, private swim instruction services at residential building pools throughout the NYC metro area, including Manhattan, Brooklyn, Queens, Long Island, Jersey City, and Westchester.

Our services include:

One-on-one swim instruction for all ages and skill levels
Beginner lessons and water safety instruction
Competitive swimming training and stroke development
Adaptive lessons for individuals with special needs

Booking and Scheduling

Lessons are scheduled by mutual agreement between you and Nuvo Swim. Lesson times, frequency, and duration are determined based on availability and your specific needs.

You are responsible for:

Ensuring pool access and availability for scheduled lesson times
Verifying that pool facilities meet safety and accessibility requirements
Notifying us of any pool closures, maintenance, or access restrictions

Payment Terms

Payment for swim lessons is due at the time of service or as otherwise agreed upon. Accepted payment methods will be communicated at the time of booking.

Pricing is subject to change with advance notice. Current rates will be provided upon inquiry.

Cancellation and Rescheduling

Please refer to our Cancellation Policy for detailed information regarding cancellations, rescheduling, late cancellations, and no-shows.

Assumption of Risk and Liability

Swimming and water activities carry inherent risks. By participating in swim lessons with Nuvo Swim, you acknowledge and assume these risks.

You agree that:

Participants engage in swim lessons at their own risk
You are responsible for disclosing any medical conditions, health concerns, or physical limitations that may affect participation
Nuvo Swim is not liable for injuries, accidents, or incidents that occur during lessons, except in cases of gross negligence or willful misconduct
Pool facilities, equipment, and premises are the responsibility of the property owner or management, not Nuvo Swim

Parental/Guardian Supervision: For minors and individuals requiring supervision, a parent, guardian, or responsible adult must remain on the pool deck during all lessons and is responsible for the participant's safety before, during, and after instruction.

Health and Safety Requirements

Participants must:

Be in generally good health and physically capable of participating in swim instruction
Inform the instructor of any medical conditions, injuries, or health concerns prior to lessons
Follow all safety instructions provided by the instructor
Not participate if they have contagious illnesses or open wounds

Nuvo Swim reserves the right to refuse or discontinue lessons if we believe participation poses a safety risk to the participant or others.

Weather and Pool Closures

Lessons may be cancelled or rescheduled due to:

Severe weather conditions (lightning, thunderstorms, extreme temperatures)
Pool closures, maintenance, or unsafe pool conditions
Building restrictions or access issues

Weather-related cancellations initiated by Nuvo Swim will be rescheduled at no additional charge. No refunds or credits are provided for pool closures or access issues beyond our control.

Conduct and Respect

We expect all clients to treat our instructors with respect and professionalism. Nuvo Swim reserves the right to terminate services immediately without refund in cases of:

Abusive, threatening, or inappropriate behavior toward instructors
Failure to comply with safety instructions
Violation of building pool rules or policies

Intellectual Property

All content on the Nuvo Swim website, including text, graphics, logos, images, and instructional materials, is the property of Nuvo Swim LLC and is protected by copyright law. You may not reproduce, distribute, or use any content without our express written permission.

Limitation of Liability

To the fullest extent permitted by law, Nuvo Swim LLC, its instructors, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from the use of our services, including but not limited to injuries, accidents, property damage, or pool-related incidents.

Our total liability for any claims related to our services shall not exceed the amount paid for the specific lesson or service in question.

Indemnification

You agree to indemnify and hold harmless Nuvo Swim LLC, its instructors, and affiliates from any claims, damages, liabilities, or expenses arising from your participation in swim lessons, your use of pool facilities, or your violation of these Terms of Service.

Dispute Resolution

Any disputes arising from these Terms of Service or the provision of swim lessons shall be governed by the laws of the State of New York. Both parties agree to attempt to resolve disputes through good-faith negotiation before pursuing legal action.

Modifications to Terms

Nuvo Swim reserves the right to modify these Terms of Service at any time. Updated terms will be posted on our website with a revised date. Your continued use of our services after changes are posted constitutes acceptance of the updated terms.

Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
